Update to CC&Rs

The Austin’s Colony HOA Board of Directors is currently in the process of updating the neighborhood’s Declaration of Covenants, Conditions & Restrictions (“CC&R”s). This process requires approval by the majority of current Austin’s Colony homeowners.

In 2021, a vote to approve the proposed CC&Rs took place but failed. As a result, we are reaching out to you for your participation in a new vote to approve the proposed rules.

As made known to Austin’s Colony previously, the neighborhood currently has CC&Rs for each individual phase. The current CC&Rs differ from phase to phase which makes management of Austin’s Colony difficult. Additionally, the State of Texas has imposed new laws that affect Austin’s Colony and must be included in our CC&Rs and consequently have been included in the proposed CC&Rs. Please know that after the vote in 2021, we took your comments and concerns into consideration and edited certain parts of the proposed CC&Rs. We hope some of these changes will assist in gaining your support in passing these proposed CC&Rs.

You may find the proposed CC&Rs and answers to some of homeowner’s frequently asked questions on our website. The vote will begin on April 1, 2022 and continue for 3 months. We intend to have various informational sessions throughout the voting process where homeowners may come and ask questions or voice their objections.

The vote process is done electronically. If we have an email address on file for you, you should be receiving an email beginning on April 1, 2022 to enter your vote. If we do not have an email on file for you, please use the contact us form to let us know.

Every homeowner in Austin’s Colony has one (1) vote – that means, if your name is on the deed to your home, you are allowed one vote. This is different than normal HOA business as typically, you are allowed one vote per lot. If you have questions about this, please contact us using our website.

We thank you greatly for your participation in the improvement of our neighborhood.

Most sincerely,
Austin’s Colony Homeowners Association, Board of Directors
